Manufacturing Terms and Conditions

Performance Rights and Mechanical Licenses

You warrant that you have all necessary licenses and rights to manufacture from the Masters submitted to us, and that you have obtained all necessary copyrights.

We will also require a copy of your MCPS license before we can commence manufacturing. More information on MCPS can be found at www.mcps.co.uk.

You also warrant that none of the Masters submitted to us contain material, the manufacture of which could render us liable to any criminal or civil proceedings, and that all recording costs and expenses, artist, writer and publisher royalties, copyright fees, and any other similar costs will be borne otherwise than by us.

Manufacturing Deposit

We require either a deposit, or a balance on your account with Kudos, of 50% of the total estimated manufacturing bill before we will commence manufacturing.

Billing

Once manufacturing is complete, you will receive an itemised invoice for all manufacturing charges. It is important for you to understand that you, the label, are responsible for any shortfall that might occur between monies due to Kudos for manufacturing (and any other charges) and monies due to you from the sale of records and that we will be entitled to treat any shortfall as a direct debt from you to us.

Liability for Production Parts

Our liability with regard to “production parts” (i.e. lacquers, Masters, artwork etc.,) is limited to the cost of replacement of the materials. Surpus paper parts will only be retained by the pressing plant for a maximum of 6 months, while vinyl metalwork will only be retained for a maximum of 18 months. After these retention periods, such surplus sleeves or unused metalwork can be destroyed by the plant without any liability to you.

Overages

Quantities ordered and supplied may differ by up to 15%. Your invoice will be based upon quantities supplied.
